Dumpster Rental Agreement
The rental
This agreement is between S&P Dumpsters ("we" or "us") and the customer who signs it ("you"). It covers every dumpster you rent from us while this version is in effect. The size, address, dates and price of each rental are on its order.
Each rental includes delivery, pickup, disposal of up to the weight included for the size you rent, and 8 days on site. We own the container at all times.
Your card or bank account on file
You authorize us to keep the card or bank account you give us on file, and to charge it without asking you again for charges that come up under this agreement:
- Weight over what's included: $75.00 per ton, going by the landfill's scale ticket.
- Days past the included days: $15.00 per day.
- Dry run: $150.00
- No tarp: $45.00
- Relocation: $150.00
- Liner: $200.00
- The fuel surcharge (5%) and sales tax, where they apply.
We'll send you a receipt or invoice for every charge, and your scale tickets are in your customer portal. If a charge is declined or a bank payment is returned, you agree to pay it when we ask, and we may hold further deliveries until it's paid.
Cancellations and refunds
You can cancel for a full refund any time before our driver heads out with your dumpster. We text you when they leave. To cancel or change your delivery date, call us at (254) 938-5090.
If you cancel after the driver is on the way, or the driver can't set the dumpster down because the spot is blocked or can't be reached, the trip is charged as a dry run ($150.00) and the rest of what you paid is refunded.
If we can't deliver within one day of the date we confirmed with you, you can pick a new date or cancel for a full refund.
Once the dumpster is delivered, the rental price isn't refundable, including when you finish early and ask for an early pickup. Extra weight and extra days are charged as described above.
Refunds go back to the card or bank account you paid with and usually show up within 5 to 10 business days. If you paid over time with Affirm or Klarna, the refund goes through them.
If a charge ever looks wrong, call us at (254) 938-5090 first and we'll explain it or make it right. You agree to contact us to resolve a billing question before disputing a charge with your card company or bank.
What can't go in
Landfills turn these away, so they can't go in the container:
- Paint, solvents and chemicals (dried latex paint is fine)
- Tires
- Car and household batteries
- Motor oil, fuel and other liquids
- Propane tanks and pressurized cylinders
- Refrigerators and A/C units with refrigerant
- Asbestos
- Medical waste
If any of these are found, we may leave the container until they're taken out, or remove them and charge you what that costs us, including any landfill fee. You're responsible for fines and cleanup costs caused by what's put in the container.
Loading it safely
Load no higher than the top of the container. Nothing may stick out over the sides or above the rim, and spread the weight evenly rather than piling it at one end, so nothing shifts or blows out on the road. Heavy materials like concrete, dirt, brick and shingles add weight fast, and you're responsible for the weight you load.
If a container is overfilled or can't be hauled safely and legally, we'll ask you to take off the excess before we move it. A trip we can't finish for that reason, or because the container is blocked or can't be reached, is charged as a dry run.
Where it goes
You choose where the container goes and make sure the spot is clear, firm and reachable by our truck. If it has to sit in a street or other public space, you're responsible for any permit that needs.
A LOADED TRUCK AND CONTAINER ARE HEAVY. WE ARE NOT RESPONSIBLE FOR DAMAGE TO DRIVEWAYS, PAVEMENT, CURBS, LAWNS, LANDSCAPING, SPRINKLERS, SEPTIC SYSTEMS OR UNDERGROUND LINES AT THE SPOT YOU CHOOSE OR ON THE WAY TO IT.
Looking after the container
While the container is at your site, you're responsible for it. Don't move it, burn anything in it, or let others fill it with waste that isn't yours. You'll pay for damage to it beyond normal wear.
Claims
You agree to cover us for claims, fines and costs that come from what's put in the container, where you had it placed, or how it was used while at your site, except to the extent they were caused by our own negligence.
Signing electronically
You agree to sign this agreement electronically, and that your electronic signature counts the same as a signature in ink. A signed copy is kept on your account. You can see it in your customer portal, or ask us for it at (254) 938-5090.
The rest
Texas law governs this agreement. If part of it can't be enforced, the rest still applies. We may update this agreement; a new version applies to orders placed after you sign it. This agreement and your orders are the whole agreement between us about your rentals.
